Sen. Mark Kelly, D-Ariz. and a retired U.S. Navy fighter pilot, said it “just doesn’t make any sense” that he could face a military court-martial after appearing in a video reminding active-duty troops they are not required to follow illegal orders. The Pentagon on Monday announced an investigation into Kelly for possible violations of military law related to the clip, which was released amid legal questions about the Trump administration’s deployment of National Guard troops to U.S. cities. President Trump earlier described the senators’ video as seditious behavior punishable by death, a remark the White House later walked back. In an interview on All Things Considered, Kelly said he believes the president was declaring that loyalty to the Constitution is punishable by death. He called the idea untenable and defended the senators’ effort to remind service members of their legal obligations.
