Virginia and D.C. Take Legal Action Against Trump’s Arch Plan

Officials in Virginia and D.C. have filed a lawsuit to block the construction of a triumphal arch in Washington, citing concerns over legal and environmental impacts.

In a significant legal challenge, Virginia and the District of Columbia have filed a lawsuit in federal court to impede the construction of a proposed triumphal arch at Memorial Circle in Washington, D.C.

The Trump administration intends to commence construction on November 5, prompting officials to intervene. Virginia Attorney General Jay Jones and D.C. Attorney General Brian Schwalb are leading this effort, underlining the potential detrimental effects of the arch on local communities.

Concerns Raised About Potential Damage

The lawsuit articulates that the construction of the arch could inflict both immediate and lasting harm on the surrounding areas. According to the attorneys general, the arch will disrupt a busy traffic circle situated at the border of the two jurisdictions and could damage a vital river ecosystem, which both governments are obligated to protect.

“Both the construction and eventual completion of the arch will hinder the operations of public services, impede our ability to comply with existing federal and state regulations, and necessitate significant expenditure to alleviate its negative effects,” they warned in the court filing.

Legal Justifications for the Blockade

Jones and Schwalb emphasized the urgency of their request, fearing that once construction begins, it would make it challenging to halt the process. They highlighted concerns that the Trump administration might claim that any delays could negatively impact national security or the operational status quo.

Moreover, the officials allege the administration is in violation of the Commemorative Works Act, which requires federal approval for memorial projects, alongside the Height of Buildings Act due to the arch’s projected height of over 130 feet. They also cite breaches of the National Environmental Policy Act and the National Historic Preservation Act.

“Virginia has a deep-rooted commitment to Arlington National Cemetery, a site that honors countless American heroes. This is why we are fighting against what we consider an unlawful project encroaching on this sacred memorial,” Jones stated.
